  3. 9. (a) What are Principle of First Degree, Accesories before facts and Accesories after the facts in relation to Accomplice evidence.

    Principle of First Degree is a person who actually commits the crime whereas Principle of second degree is one who is present and assits in the preparation of crime.

    Accessories before fact - A person who abet, incite, procure or counsel for the commission of crime. He is a person who is not present at a crime but who helps someone else in doing so.

    Accessories after fact - It means who aids a criminal after the commission of crime. A person who harbours the criminal, who shields, who protects or who assists the criminal from escaping the law.

    Notice means a persons is said to have notice of a fact, when he actually known that fact, or wilful abstention from an enquiry of search, which he ought to have made.

    Kinds of Notice:
    Actual Notice - when he actually knows it
    Constructive Notice - it is presumed or implied notice by law to the person to whom it refers.
